Please read these Terms of Use carefully before downloading or using OMOIA. By using the app, you agree to be bound by these terms.
1. Acceptance of terms
By downloading, installing, or using OMOIA (the "App"), you agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the App.
2. Description of the service
OMOIA is a mobile application that lets you save, organise, and rediscover links. It is available as a free version with a local storage limit, and as a Premium subscription that includes cloud backup and multi-device synchronisation.
3. Account and user identifier
OMOIA does not require you to create an account. A randomly generated anonymous identifier (UID) is created automatically on your device when you first launch the app. This UID is used solely to identify your data for sync purposes and is not linked to your personal identity.
4. Subscriptions and payments
OMOIA Premium is offered as an auto-renewing subscription, billed monthly. All purchases are made through the Apple App Store and are subject to Apple's payment terms.
5. Acceptable use
You agree not to use the App to:
- Store or share illegal, harmful, or offensive content
- Attempt to reverse-engineer, modify, or interfere with the App or its servers
- Use automated means to access the App's backend services
- Violate any applicable laws or regulations
7. Intellectual property
OMOIA and all associated content — including the name, logo, design, and code — are the exclusive property of the developer. Nothing in these Terms grants you any rights to use OMOIA's trademarks, logos, or other intellectual property.
Content you save (URLs, titles, notes, tags) remains yours. We do not claim any ownership over it.
8. Data and backups
Free users are responsible for their own data. We strongly recommend enabling Premium if you wish your links to be backed up. We are not liable for data loss on free accounts.
Premium users' data is stored on our servers as described in the Privacy Policy. In the event of a subscription lapse, data is retained for a grace period before deletion.
9. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the App will be uninterrupted, error-free, or free of viruses. We make no warranty that the App will meet your specific requirements.
10. Limitation of liability
To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data or loss of links.
11. Modifications to the App and terms
We reserve the right to modify or discontinue the App (or any feature of it) at any time. We may also update these Terms of Use from time to time. Continued use of the App after any changes constitutes your acceptance of the new terms.
12. Governing law
These Terms are governed by the laws of France, without regard to conflict-of-law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of France.
